These general terms and conditions of sale (hereinafter the “GTC”) are concluded between the company NUYUN, and any natural or legal person (hereinafter the “Customer”) wishing to make a purchase via the website www.nuyun.fr (hereinafter the “Site”). These T&Cs specify the conditions for ordering, payment, delivery and management of any returns of products ordered by the Customer.

Article 1 – Purpose

The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in the context of the online sale of products offered by NUYUN on the Site. They apply, without restriction or reservation, to all sales of products offered on the Site.

Article 2 – Acceptance of the general conditions of sale

By placing an order on the Site, the Customer expressly and unreservedly accepts these General Terms and Conditions. The Customer acknowledges having read them before placing an order. Acceptance of the General Terms and Conditions is indicated by a checkbox when confirming the order. The Customer also acknowledges having the legal capacity to enter into a contract.

Article 3 – Products

3.1. Product Description
The products offered for sale are those appearing on the Site on the day the Customer consults the Site. NUYUN takes the greatest care in putting online information relating to the essential characteristics of the products, in particular by means of technical sheets and photographs illustrating the products. However, variations may exist, in particular due to technical limitations of color rendering on the Customer's computer equipment.

3.2. Product availability
Product offers are valid while stocks last. In the event that a product is unavailable after the order has been placed, NUYUN will inform the Customer by email. The order will be automatically cancelled and refunded.

Article 4 – Prices

4.1. Price determination
Product prices are indicated in euros (€), all taxes included (TTC), excluding delivery costs. NUYUN reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time of validation of the order, subject to availability.

4.2. Shipping costs
Delivery costs are indicated to the Customer before the final validation of his order. They vary depending on the amount of the order and the delivery address.

Article 5 – Order

5.1. Ordering process
To place an order, the Customer must follow the following steps:

• Selecting products and adding to cart
• Validation of the contents of the basket
• Identification on the Site if the Customer is not already registered
• Choice of delivery method
• Acceptance of the T&Cs
• Payment validation

5.2. Order confirmation
A confirmation email summarizing the order (products, price, quantity, etc.) will be sent to the Customer by NUYUN. The sale will only be considered final after sending this confirmation email and receipt of the full price.

Article 6 – Payment

6.1. Payment Terms
Payment is made online by credit card (Visa, Mastercard, American Express) or via any other means of payment offered on the Site. The Customer guarantees to NUYUN that he has the necessary authorizations to use the chosen payment method.

6.2. Payment security
Payment is secured through the use of SSL security protocols. The Customer's banking data never transits in clear text over the network.

6.3. Default of payment
NUYUN reserves the right to suspend or cancel any order in the event of non-payment or payment incident.

Article 7 – Delivery

7.1. Delivery times
Delivery times vary depending on the destination and the chosen delivery method. NUYUN undertakes to deliver the products within a reasonable time, generally 3 to 10 working days.

7.2. Delivery address
The products are delivered to the delivery address indicated by the Customer when ordering. The Customer is required to check the completeness and conformity of the information he provides to NUYUN. In the event of an error in the wording of the recipient's contact details, NUYUN cannot be held responsible for the impossibility of delivering the product(s).

7.3. Delay in delivery
In case of late delivery, the Customer will be informed by email. If delivery has not taken place within 30 days of the order date, the Customer may cancel the order by email and will be fully refunded within 14 days.

7.4. Receipt of order
The Customer is required to check the condition of the delivered products. Any anomaly noted (damage, product missing from the delivery note, damaged package, broken products, etc.) must be reported to the carrier and to NUYUN within 3 days of receipt.

Article 8 – Right of withdrawal

8.1. Conditions for exercising the right of withdrawal
In accordance with the legal provisions in force, the Customer has a period of 14 days from receipt of the products to exercise his right of withdrawal without having to provide reasons or pay a penalty.

8.2. Return Policy
To exercise the right of withdrawal, the Customer must notify his decision to withdraw to NUYUN by e-mail (hello@nuyun.fr) or by post. The products must be returned in their original packaging and unused, accompanied by the purchase invoice, within 14 days following notification of the decision to withdraw. The return costs are the responsibility of the Customer.

8.3. Refund
In the event of withdrawal, NUYUN will reimburse the Customer for all sums paid, including delivery costs (with the exception of additional costs resulting from the Customer's choice of a delivery method other than the less expensive standard delivery method offered by NUYUN) without undue delay and in any event no later than 14 days from receipt of the returned products. The reimbursement will be made via the same means of payment as that used when ordering, unless the Customer expressly agrees to another means of reimbursement.

Article 9 – Warranty and liability

9.1. Legal guarantee
The products benefit from the legal guarantee of conformity provided for by articles L. 217-4 et seq. of the Consumer Code, and the guarantee against hidden defects provided for by articles 1641 et seq. of the Civil Code.

9.2. Implementation of the guarantee
In the event of non-conformity of a product sold, it may be returned, exchanged or refunded. All claims, requests for exchange or refund must be made by email or by mail within 30 days of delivery.

9.3. Responsibility
NUYUN cannot be held liable for non-compliance with the legislation of the country where the products are delivered. It is the Customer's responsibility to check with the local authorities the possibilities of importing or using the products they plan to order.

Article 10 – Personal data

10.1. Data collection and processing
NUYUN collects and processes the Customer's personal data in accordance with its Privacy Policy, available on the Site. The information collected is subject to computer processing intended for order management and improvement of the services offered.

10.2. Customer Rights
In accordance with the Data Protection Act of 6 January 1978, the Customer has the right to access, modify, rectify and delete data concerning him/her. The Customer may exercise these rights by sending an e-mail or letter to NUYUN.

Article 11 – Intellectual property

All elements of the Site (texts, visuals, logos, brands, etc.) are protected by intellectual property law. Any reproduction or use, in whole or in part, without prior authorization from NUYUN is strictly prohibited and constitutes an infringement.

Article 12 – Applicable law and disputes

These General Terms and Conditions are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, the French courts will have sole jurisdiction to settle disputes.

Article 13 – Modification of the general conditions of sale

NUYUN reserves the right to modify these T&Cs at any time. The new T&Cs will apply to any order placed after they are posted on the Site. The Customer is therefore invited to regularly consult the T&Cs in order to be aware of any possible modifications.
